Criminal charges are still on the table in the devastating fatal shooting on the set of Alex Baldwin’s western movie Rust, local prosecutors say.
Legal documents have shown that the actor, 63, was drawing a gun across his body and pointing it at a camera while “practicing a quick draw” in rehearsals in Santa Fe, New Mexico.
When he fired it, cinematographer Halyna Hutchins was tragically killed, while director Joel Souza was also injured.
Affidavits which included statements from Joel as well as camera operator Reid Russell said that Alec was told he was handed an unloaded prop gun by First Assistant Director David Halls before it was unloaded.

The prosecutor in the case said that there were an “enormous amount of bullets” on the set which needed to be investigated.
Mary added that reports of crew members using this live ammunition for target practice prior to the fatal shooting on Thursday were “unconfirmed”.
Wednesday’s much-anticipated press conference from law enforcement officers in New Mexico is set to offer more information on the shooting, with police saying that the investigation is far from over.
Juan Rios, the spokesperson for Santa Fe Sheriff’s Office told Deadline : “Both search warrants have been executed,” in reference to the two documents issued by a New Mexico judge on October 22 to let officers investigate the Bonanza Creek Ranch location of the shooting.
“More search warrants could be coming, but nothing has been filed yet. It’s going to be ongoing for a while.”
According to one search warrant executed by the office last week, the last person to handle the gun was the film’s rookie armorer, Hannah Gutierrez-Reed. She is said to have left the weapon unattended on the cart along with two other guns in the early hours of October 21.
On Tuesday a haunting final photo surfaced of Halyna filming in the chapel she was accidentally shot and killed.
Rust’s head electrician Serge Svetnoy shared the image of the late cinematographer filming in the church alongside Alec Baldwin.
The electrician had been standing near Halyna when she was shot and recalled the devastating moment “her blood was on my hands” as she lay dying in his arms.
In his post he wrote: “I do not wish anyone to go through what I went through, what her husband Matt Hutchins and her son Andros went through, and the actor Alec Baldwin, who has been handed a gun on set. He has to live with the thought that he took the life of the human because of unprofessional people.”
